Terms of Service

These Terms of Service (“Terms”) govern your use of the Tomi Frame hardware device, companion mobile application, and cloud service (collectively, the “Service”). By purchasing a device or creating an account, you agree to these Terms. This is the English counterpart of the Turkish version; they are intended to say the same thing.

1. Account

You must create an account to use the Tomi Frame companion app. You are responsible for maintaining the security of your account credentials. You must be at least 13 years old to create an account.

2. Hardware

Tomi Frame devices are sold as-is and covered by a limited warranty against manufacturing defects. Warranty does not cover physical damage, water damage, or unauthorized modifications. We reserve the right to refuse warranty claims that show evidence of abuse.

These Terms do not limit the mandatory consumer rights you have under your local law — including the statutory warranty period, which for buyers in Turkey is set by Law No. 6502 and applies regardless of anything stated here.

3. Permitted Use

You may use the Service for personal, non-commercial purposes. You may not:

• Reverse-engineer, decompile, or tamper with the firmware in ways that damage other users or the service
• Use the Service to send spam or harass others
• Attempt to gain unauthorized access to other users' data
• Use the API at volumes that degrade service for others

4. Subscriptions and Payments

Tomi Frame is not yet on sale. No payment is taken anywhere on this site, and joining the waitlist creates no obligation for you or for us. The terms in this section describe how sales will work once the device is available.

The Tomi Frame hardware is a one-time purchase. Every feature a regular user needs is included with the device at no additional cost — there is no consumer subscription and no paid tier gating plugins, art, photo upload, or scheduling.

The optional Developer tier, intended for people publishing their own plugins or driving the device programmatically, is available either as a one-time purchase or as a monthly subscription. A monthly Developer subscription can be cancelled at any time and stops at the end of the paid period.

Refunds for hardware are available within 30 days of delivery if the device is defective or significantly not as described. This is in addition to any statutory right of withdrawal you have under your local consumer law, which these terms do not limit.

5. Service Availability

We aim to maintain 99.5% uptime for the cloud backend. Scheduled maintenance windows will be announced 24 hours in advance. Your device will continue to display the last successful dashboard during any outage.

We reserve the right to discontinue the cloud service with 12 months' notice. In that event, we will release an open-source version of the backend so users can self-host.

6. Third-Party Integrations

Integrations with Google Calendar, Spotify, GitHub, and other services are subject to those services' own terms. We are not responsible for disruptions caused by changes to third-party APIs.

7. Intellectual Property

The Tomi Frame name, logo, software, and firmware are owned by Tomi Frame. You may not reproduce, redistribute, or sell them without written permission. The companion app source code may be made available under a separate open-source license in the future.

8. Disclaimer of Warranties

The cloud service is provided “as is” without warranty of any kind. We do not guarantee that the service will be uninterrupted or error-free. Third-party data (weather, crypto prices, news) is provided for informational purposes only — do not rely on it for financial or safety decisions.

9. Limitation of Liability

To the maximum extent permitted by law, Tomi Frame's total liability for any claim arising from these Terms is limited to the amount you paid for the product in the 12 months preceding the claim.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 30 days before they take effect. Continued use of the Service after that date constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of Turkey, without regard to conflict of law principles. Disputes will be resolved in the courts of Istanbul, Turkey. If you are a consumer, your right to apply to the Turkish consumer arbitration committees and consumer courts is unaffected.
