Bu metin, 6698 sayılı Kişisel Verilerin Korunması Kanunu (“KVKK”) madde 10 uyarınca, Tomi Frame mobil uygulamasını ve Tomi Frame çerçevesini kullananların kişisel verilerinin nasıl işlendiğini açıklar. Bekleme listesi için ayrı bir aydınlatma metni vardır; daha ayrıntılı açıklama Gizlilik Politikası’ndadır.

1. Veri Sorumlusu

Veri sorumlusu, Tomi Frame’i işleten Tamara Midas Özlü’dür. İletişim: [email protected]. Tomi Frame, onun adına şahıs firması olarak kurulmaktadır; tescil tamamlandığında ticari unvan, adres ve vergi bilgileri bu metne eklenecektir.

2. İşlenen Kişisel Veriler

• Kimlik ve iletişim: e-posta adresi; Apple ile girişte Apple’ın verdiği kullanıcı kimliği. Ad ve fotoğraf istenmez.
• Hesap güvenliği: parolanın özet (hash) değeri; parola düz metin olarak tutulmaz.
• Cihaz: çerçevenin kimliği, yazılım sürümü, son bağlantı zamanı, pil seviyesi ve (donanım destekliyorsa) çerçevenin ölçtüğü oda sıcaklığı ve nemi.
• Ekran içeriği: widget ayarları, düzenler, çizimler, yüklediğiniz görseller ve fotoğraflar; saat dilimi ve dil tercihi.
• Bağladığınız hizmetler: Google Takvim, Spotify gibi hizmetlerin erişim anahtarları (şifreli saklanır) ve ekranınız için çekilen içerik.
• Sağlık verisi (özel nitelikli): yalnızca açık rızanızla, telefonunuzun sağlık uygulamasındaki o günkü toplam adım sayısı (§9).
• İşlem güvenliği: IP adresi, istek zamanları ve durum kodları gibi sunucu kayıtları.

3. İşleme Amaçları

Hesabınızı oluşturmak ve yönetmek; çerçevenizi eşlemek, ekran görüntüsünü üretip çerçevenize ulaştırmak; bağladığınız hizmetlerden içerik çekmek; yazılım güncellemelerini sunmak; hesapla ilgili e-postaları (parola sıfırlama gibi) göndermek; güvenliği sağlamak, kötüye kullanımı önlemek ve hataları gidermek. Verileriniz reklam, pazarlama ya da profilleme amacıyla kullanılmaz ve satılmaz.

4. Hukuki Sebepler

Hesap, cihaz ve ekran verileri bir sözleşmenin kurulması ve ifası için gerekli olduğundan (KVKK m.5/2-c); işlem güvenliği kayıtları meşru menfaatimiz için (m.5/2-f) işlenir. Adım sayısı özel nitelikli kişisel veri olduğundan yalnızca açık rızanızla (m.6) işlenir.

5. Toplama Yöntemi

Veriler mobil uygulama, çerçeve ve web sitesi üzerinden elektronik olarak; bağladığınız hizmetlerden ise sizin verdiğiniz yetkiyle toplanır.

6. Aktarım

Veriler, hizmeti bizim adımıza çalıştıran sağlayıcılara aktarılır: Supabase (veritabanı, Avrupa Birliği), Railway (uygulama sunucusu, Amerika Birleşik Devletleri), Resend (e-posta gönderimi) ve Cloudflare (alan adı ve ağ). Bu sağlayıcılar verileri kendi amaçları için kullanmaz. Barındırmanın, ticari satışlar başlamadan önce Türkiye’ye taşınması planlanmaktadır; taşındığında bu bölüm güncellenecektir. Verileriniz yasal zorunluluk dışında başka kimseyle paylaşılmaz.

7. Saklama Süresi

Hesap verileri hesabınız açık olduğu sürece saklanır. Hesabınızı uygulamadan (Ayarlar → Hesabı Sil) ya da bu sayfadan sildiğinizde ilgili veriler 30 gün içinde kalıcı olarak silinir. Adım sayısı en fazla 36 saat tutulur.

8. Haklarınız (KVKK m.11)

Kişisel verilerinizin işlenip işlenmediğini öğrenme, bilgi talep etme, işleme amacını ve amaca uygun kullanılıp kullanılmadığını öğrenme, aktarıldığı kişileri bilme, eksik ya da yanlışsa düzeltilmesini, KVKK m.7 çerçevesinde silinmesini isteme, bu işlemlerin aktarıldığı kişilere bildirilmesini isteme, otomatik analiz sonucu aleyhinize bir sonuca itiraz etme ve kanuna aykırı işleme nedeniyle zarara uğrarsanız zararın giderilmesini talep etme haklarına sahipsiniz. Başvurularınızı [email protected] adresine iletebilirsiniz; en geç 30 gün içinde yanıtlanır. Kişisel Verileri Koruma Kurulu’na şikâyet hakkınız saklıdır.

9. Adım Verisi için Açık Rıza

Adımlar widget’ını kullanmak isterseniz uygulama, telefonun izin penceresinden önce ayrıca açık rızanızı ister. Rıza verirseniz: telefonunuzdaki Apple Sağlık ya da Health Connect’ten yalnızca o günkü toplam adım sayısı okunur; yalnızca sizin çerçevenizde göstermek için sunucumuza gönderilir; en fazla 36 saat tutulur; sağlık verisine hiçbir şey yazılmaz; reklam ya da profilleme için kullanılmaz ve kimseyle paylaşılmaz. Rıza vermek zorunlu değildir; vermezseniz yalnızca Adımlar widget’ı çalışmaz. Rızanızı istediğiniz an uygulamada Ayarlar → Adım verisi bölümünden geri çekebilirsiniz; o anda saklanan değer silinir ve yeni veri alınmaz.

This notice explains how the personal data of people who use the Tomi Frame app and a Tomi Frame frame is processed, under Türkiye’s data protection law (KVKK, art. 10). The waitlist has its own notice; the Privacy Policy has the longer explanation.

1. Who is responsible

The data controller is Tamara Midas Özlü, who runs Tomi Frame. Contact: [email protected]. Tomi Frame is being registered as her sole proprietorship; the trade name, address and tax details will be added here once registration is complete.

2. What we process

• Identity and contact: your email; with Sign in with Apple, Apple’s user id. No name or photo.
• Account security: a hash of your password, never the password itself.
• Device: the frame’s id, firmware version, last contact, battery level and, where the hardware has the sensor, the room temperature and humidity it measures.
• Screen content: widget settings, layouts, drawings, images and photos you upload; your time zone and language.
• Connected services: access tokens for services such as Google Calendar or Spotify (stored encrypted) and the content fetched for your screen.
• Health data (special category): only with your explicit consent, today’s total step count from your phone’s health app (§9).
• Security logs: server records such as IP address, request times and status codes.

3. Why

To create and run your account; to pair your frame and render and deliver its screen; to fetch content from services you connect; to deliver firmware updates; to send account email such as password resets; and to keep the service secure and fix faults. Your data is not used for advertising, marketing or profiling, and is not sold.

4. Legal basis

Account, device and screen data: necessary to enter into and perform our contract with you (KVKK art. 5/2-c). Security logs: our legitimate interest (art. 5/2-f). The step count is special-category data and is processed only with your explicit consent (art. 6).

5. How it is collected

Electronically, through the app, the frame and the website; from services you connect, with the authorisation you give.

6. Where the data goes

To providers that run the service on our behalf: Supabase (database, European Union), Railway (application server, United States), Resend (email delivery) and Cloudflare (domain and network). They do not use the data for their own purposes. Hosting is planned to move to Türkiye before commercial sales begin; this section will be updated when it does. Your data is not shared with anyone else unless the law requires it.

7. How long we keep it

Account data is kept while your account is open. When you delete the account in the app (Settings → Delete account) or here, the related data is permanently removed within 30 days. The step count is kept for at most 36 hours.

8. Your rights

You can ask whether and how your data is processed, to whom it is transferred, to have it corrected or deleted, and to object to an automated decision against you; and claim compensation for unlawful processing (KVKK art. 11). Write to [email protected]; we answer within 30 days. You may also complain to Türkiye’s Personal Data Protection Authority, or your own country’s authority.

9. Explicit consent for the step count

If you want the Steps widget, the app asks for your explicit consent before the phone’s permission sheet. If you agree: only today’s total step count is read from Apple Health or Health Connect; it is sent to our server only to show on your own frame; it is kept for at most 36 hours; nothing is written to your health data; it is not used for advertising or profiling and not shared. Consent is optional — without it only the Steps widget does not work. You can withdraw it at any time in the app under Settings → Step data; the stored value is deleted at once and no more is accepted.
